Laws in Colombia for surrogacy treatments
Surrogacy is relatively new compared to other techniques. This is one of the reasons why many countries have not imposed laws that regulate it. In the latter context, Colombia is one of the countries that are transparent about the situation.
Worldwide there are four types of laws that each country consults with its respective cabinet and experts on the subject. Which are:
- Surrogacy with economic remuneration: They are the countries that approve the law, without restriction to the pregnant woman obtaining financial remuneration for time and physical wear and tear. These countries include New Zealand, Australia or Greece. It includes the income of the months that the pregnant woman did not work, these prices vary in each country.
- Surrogacy only for altruistic purposes: Permits are approved, on the condition that pregnant women offer themselves without financial remuneration. All expenses related to the pregnancy are borne by the intending parents. Most of the time, they must start paying month by month, after the pregnancy is confirmed. Among the countries that favor this law we find: United Kingdom, Canada, Australia, Brazil.
- There is no legislation that approves or prohibits it: Countries such as Russia, Argentina, India and Colombia can carry out the surrogacy procedure, but in this case they do not have a law that protects or restricts them. Everything is agreed between the patients and the specialized center, and most of it carries out the legal procedures for the new family member.
- Absolute prohibition : Germany, France, Italy and Switzerland are some of the countries that do not allow the practice of surrogacy in any of its forms, or under explicit conditions. Usually couples from these countries go to other nations to make surrogacy possible.
Each country has a partial legislation on surrogacy, many times the other citizen laws influence to determine its validation. There are countries where it is completely prohibited, and the ability to surrogate is complicated. The fear of returning to their country of origin and that the minor cannot be accepted also plays a role.
It is important to know the laws of each country and address the theory of each situation that may arise.
Having a specialized center that is an expert in the legal part is an advantage, since it is not the first time that they deal with these types of conditions, having experience in the steps to be taken.
It can be seen that Colombia is one of the countries of the third type, which does not have legislation on the surrogacy process. If there have been attempts to bring a law, but they have not had great repercussion and in the end no type of pronouncement is made.
The entities that have requested a regularization of surrogacy, are inclined by laws where the pregnant woman only applies altruistically and voluntarily, without receiving financial remuneration. This is based on other Colombian laws, which defend the right of citizens not to be treated as services or commerce.
However, the debates about this practice are very diverse. Times have been changing, both in genetics and in family nuclei. The thought must be expanded, discovering new ways that each couple or person can fulfill their dream without harming others.
In Colombia Celagem Surrogacy, we are committed to legal procedures, so that the intended parents do not have problems when returning to the interior of the country or to their country of origin.
Surrogacy opens the door to thousands of couples who for various reasons cannot gestate naturally, seeking solutions so that the new individual can carry genetic material, which will be passed on to other generations.
In countries where the law is restricted in its entirety, thousands of citizens have expressed their discontent. This is because the practice is more widely used among couples. However, studies have concluded that the number of couples with some difficulty conceiving has increased on a small scale.
A key point is that the ages at which pregnancy is sought are later, which makes a successful pregnancy difficult, so couples resort to surrogacy or adoption methods if they do not care about preserving the genetic material.
Among the countries that practice surrogacy, Colombia has a regulated price standard, compared to the rest of the international agencies that join surrogacy.
The reasons for these prices can be diverse, the budget of the clinical part, the legal advice, the genetic methodology that is involved in the process and the psychological counseling.
While the legislature in Colombia is determined on surrogacy. The country's agencies are equipped with all the information, which guarantee couples a transparent and smooth procedure. Remembering that surrogacy is a practice that seeks to support the consolidation of families, where for biological reasons or due to natural impossibility, couples do not achieve pregnancy.
